Dreptul la somaj in Germania

In lunile care au trecut schimbarile din economia mondiala, de fapt recesiunea, au afectat si economia germana astfel incit multi dintre noi si-au pus intrebarea ce vor face daca in cazul extrem vor ramine fara loc de munca. Pe vechiul forum s-a discutat iar o parte din persoanele implicate in discutie au aflat o serie de detalii privind acest subiect. Teoretic avem aceleasi derepturi ca si un lucrator german, aceasta insemnind ca suntem eligibili pentru ajutor de somaj dupa 12 luni de munca continua in Germania.

Dupa cele 12 luni de munca, perioada de ajutor de somaj variaza de la 3 la 12 luni in functie de perioada lucrata. In situatia cea mai grava se afla insa cei care au lucrat sub 12 luni in Germania pentru care nu s-a eliberat inca o carte de asigurari sociale ("carnetul roz"), si carora Arbeitsamt nu le garanteaza nici macar raminerea in Germania pentru citeva luni pentru gasirea unui nou loc de munca.

Cel mai important aspect este ca Arbeitsamt nu pune la dispozitie o metodologie exact de prelucrare a acestor data, raspunsul oficial, si trebuie sa recunoastem ca si foarte confuz si deloc lamuritor, al Biroului Bonn pentru probleme Greencard fiind urmatorul:

"After the issue of a first work permit, other permits may also be issued as long as they are in line with the prerequisits of the IT-specialist program. But the total duration of these work permits combined may not exceed five years. There will not be another check to see if the job could be filled by a German or EU-specialist. The other requirements however, for example those concerning comparable salary, must still be met.

Please note also, that the residence permit and the work permit ends
at the very moment that a contract with the current employer ends!
Please contact the immigration office concerning our present-day situation and ask there how long you can stay without a job. You should in time hand in an application for the issuing of another esidence permit, which allows you to seek for a job.

Anybody who has worked for more than 12 months, is also eligible to receive unemployment benefit from the local job office (Arbeitsamt).
There you may also inquire all details about the duration and the amount of the unemployment benefit.

Anybody who is fearing to loosing his job or has lost his job already should contact us immediately, so that we can assisst the individual in finding a new position."
